Welcome to Finally Clear™ (“Finally Clear,” “Company,” “we,” “us,” or “our”). These Terms and Conditions of Service (“Terms”) constitute a legally binding agreement between you (“User,” “Patient,” or “you”) and Finally Clear governing your access to and use of our website, screening questionnaires, telehealth coordination, and digital patient communication tools.
BY CHECKING ANY TERMS ACKNOWLEDGMENT BOX, PAYING A CONSULTATION OR SUBSCRIPTION FEE, OR ACCESSING OUR PLATFORM, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE OUR SERVICES.
1. Scope of Services & Telehealth Nature
Finally Clear is a specialized healthcare management and digital coordination platform. Finally Clear itself is not a licensed medical practice, pharmacy, or clinical laboratory. Medical evaluations, diagnosis, and prescription issuance are performed exclusively by independent, licensed healthcare providers (such as Physician Assistants, Nurse Practitioners, or Physicians) licensed to practice in your physical state (Arizona, Georgia, or Tennessee).
- No Guarantee of Prescription: Completing our 5-minute intake quiz, paying a consultation fee, or undergoing an evaluation does NOT guarantee that you will be prescribed isotretinoin (Accutane) or any other medication. Prescriptions are issued solely at the medical discretion of your licensed treating clinician based on diagnostic criteria and patient safety.
- State Modalities: Depending on your state of residence, your clinical encounter will be conducted either via asynchronous store-and-forward image and chart review (Arizona and Tennessee) or synchronous live audio-video consultation (Georgia), pursuant to state medical board regulations.
2. Eligibility Requirements
To access our telehealth platform, you represent and warrant that:
- You are at least 18 years of age (or you are the parent/legal guardian acting on behalf of a minor patient aged 13–17).
- You are physically located within Arizona, Georgia, or Tennessee at the time of your clinical intake and virtual encounters.
- All information, acne history, medical records, and identity documents you submit are truthful, accurate, and complete.
3. Federal iPLEDGE REMS Compliance Requirements
Isotretinoin is an FDA-regulated systemic retinoid carrying severe teratogenic risks (potential for catastrophic birth defects). As a condition of receiving isotretinoin therapy, you agree to strictly comply with all federal iPLEDGE REMS requirements:
- Patients Who Can Become Pregnant: You agree to undergo mandatory initial and monthly pregnancy screenings (including laboratory serum/urine tests or approved at-home test photo uploads under clinical supervision), commit to using two forms of effective contraception simultaneously or practice total abstinence, complete monthly comprehension questions within the designated timeframe, and pick up your prescription within the strict 7-day window[cite: 1, 3, 9].
- Lockout Acknowledgment: You understand that missing your 7-day dispensing window will result in an automated system expiration of your prescription, requiring additional testing before a new prescription can be authorized.

4. Billing, Platform Fees & Refund Policy
- Platform Subscription Fee: Finally Clear charges a recurring platform fee of $99 per month[cite: 1, 2, 8]. This flat fee covers your virtual clinician reviews, direct portal messaging with your care team, routine lab tracking, and ongoing administrative iPLEDGE REMS concierge management[cite: 1, 8].
- Unbundled Medication & Lab Costs:
- Medication: Your prescription is routed to your preferred local retail pharmacy (or partner mail-order pharmacy). You are responsible for paying the pharmacy directly using your commercial health insurance, cash, or discount programs like GoodRx[cite: 1, 4, 8].
- Labs: Required diagnostic blood tests (lipid panels, liver function tests) and clinical pregnancy tests are billed directly to you or your insurance by the performing laboratory (e.g., Quest Diagnostics or Labcorp)[cite: 1, 4, 8].
- 100% Clinical Qualification Refund Guarantee: If our clinical provider determines during your initial diagnostic intake that you are clinically ineligible or unsafe for our isotretinoin protocols, your initial consultation or platform fee will be 100% refunded[cite: 1, 4, 8].
- Cancellation Policy: You may cancel your $99/month platform subscription at any time through your account portal or by contacting support@finallyclear.com with at least 5 business days’ notice prior to your next recurring billing cycle[cite: 2, 8]. 5. TCPA & Mandatory SMS Messaging Disclosures
By providing your mobile telephone number and checking our consent box, you provide express written consent under the Telephone Consumer Protection Act (“TCPA”) to receive automated operational, administrative, clinical, and informational SMS text messages from Finally Clear.
- Consent Not Required for Purchase: Consenting to receive automated text messages is not a condition of purchasing any medication or service.
- Message Frequency & Standard Rates: Message frequency varies based on your appointment status, prescription refill schedule, and iPLEDGE compliance cycles. Message and data rates may apply according to your cellular service plan.
- Opt-Out Mechanism: You can revoke your consent and stop receiving SMS messages at any time by texting STOP to any message you receive. For assistance, text HELP or email support@finallyclear.com.
- Carrier Disclaimer: Wireless carriers and Finally Clear are not liable for delayed or undelivered text messages.
6. Medical Emergency Disclaimer
FINALLY CLEAR IS NOT AN EMERGENCY MEDICAL SERVICE. IF YOU ARE EXPERIENCING A MEDICAL EMERGENCY, SEVERE ALLERGIC REACTION, SUDDEN SHORTNESS OF BREATH, OR ACUTE MENTAL HEALTH DISTRESS, IMMEDIATELY CALL 911 OR GO TO THE NEAREST EMERGENCY ROOM. IF YOU EXPERIENCE SUICIDAL THOUGHTS OR ACUTE PSYCHIATRIC CRISIS, CALL OR TEXT THE 988 SUICIDE & CRISIS LIFELINE.
7. Intellectual Property
All content, logos, trademarks, website text, intake questionnaire formats, software scripts, and visual design elements on the Finally Clear platform are the exclusive intellectual property of Finally Clear and are protected by United States copyright and trademark laws[cite: 1, 3, 14]. You may not copy, reproduce, distribute, or create derivative works without prior written consent.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW, FINALLY CLEAR, ITS DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, DELAYS IN PHARMACY DISPENSING, LAB ERRORS, OR ADVERSE MEDICAL OUTCOMES ARISING OUT OF CLINICAL TREATMENT ADMINISTERED BY INDEPENDENT HEALTHCARE PROVIDERS. OUR TOTAL AGGREGATE LIABILITY ARISING FROM OR RELATING TO THESE TERMS SHALL NOT EXCEED THE TOTAL PLATFORM FEES PAID BY YOU TO FINALLY CLEAR DURING THE SIX (6) MONTHS PRECEDING THE CLAIM.
9. Governing Law & Dispute Resolution
These Terms and your use of the platform shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law principles. Any dispute, claim, or controversy arising out of or relating to these Terms or the breach thereof shall be resolved through binding confidential arbitration administered in Maricopa County, Arizona, in accordance with the commercial rules of the American Arbitration Association.
